CONDITIONS OF PARTICIPATION FOR THE COMPETITION

1. SCOPE OF APPLICATION

These conditions of participation apply to the competition organized by UZIN UTZ SE in connection with the BAU trade fair. By participating in the competition, each participant accepts these conditions of participation.

2. ORGANIZER OF THE SWEEPSTAKES

The sweepstake is conducted by UZIN UTZ SE, Dieselstraße 3, 89073 Ulm, Germany.

3. ELIGIBILITY

Persons who have reached the age of 18 and are resident in the Federal Republic of Germany are eligible to participate. Participation is free of charge and in no way dependent on the purchase of goods or the use of a service.

4. PROCEDURE OF THE COMPETITION

The competition will take place from 17.04.2023 to 22.04.2023 8 pm. In order to participate in the competition, the participant must successfully complete the competition form on the de.uzin-utz.com/news-events/bau-2023/gewinnspiel-sneakers website. Participation is only possible once and within the participation period. Responses received after the closing date will not be considered.

5. PROFITS, DETERMINATION AND TRANSMISSION OF PROFITS

The advertised prize is a pair of shoes (sneakers) from a total of 120 pairs in different colors of our brands. The advertised prize is not necessarily identical to the item won, deviations in particular with regard to model and color are possible. The prizes are non-transferable and cannot be paid out in cash. Claims against UZIN UTZ SE for material defects or defects of title of a prize are excluded.

The winner will be determined by drawing lots no later than four weeks after the campaign period. The winner will be notified by e-mail. The contact details cannot be changed after submission. Each participant notified in this way is obliged to inform UZIN UTZ SE within two weeks of the notification being sent whether he or she accepts the prize. If no such notification is received by UZIN UTZ SE within this period, UZIN UTZ SE reserves the right to select another participant by lot and notify him/her accordingly. The shoes will be produced within three months of notification of the prize and then shipped directly to the address provided. Upon submission for shipment, the risk of loss of the item shall pass to the winner.

6. DATA PROTECTION

In order to carry out the sweepstakes, UZIN UTZ SE will process the first name, last name, address, e-mail address, company name, shoe size of the participants, brand and, after voluntary indication, the size of the company. The personal data collected as part of the competition will be stored, processed and used exclusively for the purpose of carrying out and processing the competition. This allows us Art. 6 (1) lit. f DSGVO, because we have a legitimate interest in recognizing multiple entries and fraud attempts, as well as to identify a contact person to contact for the prize distribution.  During processing, the data will be passed on to the employees entrusted with organizing the prize draw, insofar as this is necessary to fulfill the purpose. The data will not be passed on to third parties. Once the competition has been completed, the personal data will be deleted.

As data subjects, the participants are entitled to the rights set forth in Art. 15 et seq. DSGVO, in particular the right to information, deletion, correction, restriction of processing and a right of appeal to the competent supervisory authority. For revocation and/or deletion, an informal message by e-mail to: info(at)uzin-utz.com is sufficient. If the request for deletion of data is made before the end of the competition, further participation in the competition is no longer possible.

6.2 Data subject rights

You are entitled to the following data subject rights:

the right to information according to Article 15 DSGVO,
the right to rectification according to Article 16 DSGVO,
the right to erasure according to Article 17 DSGVO,
the right to restriction of processing according to Article 18 DSGVO,
the right to data portability according to Article 20 DSGVO,
the right to lodge a complaint with a supervisory authority pursuant to Article 77 of the GDPR
the right to revoke consent given at any time, without this affecting the lawfulness of the processing carried out on the basis of the consent until revocation.

Insofar as we base the processing of personal data on a balance of interests, you may object to the processing pursuant to Art. 21 DSGVO. The objection must be met in whole or in part if there are valid reasons that oppose further processing. Please inform us of these reasons with the objection. We will then review the situation and either discontinue or adjust the processing or inform you of the weighty reasons for continuing the processing.

6.3 Legal basis and purpose of collection and processing
Personal data provided to Uzin Utz as part of the competition will be stored, processed and used by Uzin Utz exclusively for the purpose of carrying out and processing the competition. We are permitted to do this by Art. 6 Para. 1 lit. f DSGVO because we have a legitimate interest in recognizing multiple entries and attempts at fraud. In addition, without address data, it is not possible to contact the winners or send the prize.

6.4 Type of personal data
In order to carry out the competition, Uzin Utz will process certain personal data from you, such as your first name, last name, address, e-mail address and shoe size. The personal data collected and processed from you can be found on the form for the competition.

6.5 Recipients of the personal data
During processing, the data will be passed on to the employees entrusted with the organization of the sweepstakes, insofar as this is necessary for the fulfillment of the purpose. The data will not be passed on to third parties.

6.6 Duration of storage / deletion
The personal data will be deleted after the competition has been completed. If you exercise your right to deletion and the request to delete data is made before the end of the competition, further participation in the competition is no longer possible.

7. FINAL PROVISIONS

UZIN UTZ SE reserves the right to unilaterally change these conditions of participation for good cause or to terminate the competition prematurely. This applies in particular if proper implementation cannot be guaranteed for technical or legal reasons, in the event of mass misuse of the promotion or subsequent legal inadmissibility due to a change in the legal situation.

Legal recourse is excluded. The law of the Federal Republic of Germany applies.
